Terms and Conditions for Magazine Subscription Service
These Terms and Conditions (“Terms”) govern the subscription service (“Service”) provided by TRMedia Ltd. (“Company”), located at Unit 5B, Valley Industries, Cuckoo Lane, Tonbridge, Kent, TN11 OAG, to you (“Subscriber”). By subscribing to the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not subscribe to the Service.
1. Subscription Agreement
1.1. By subscribing to the Service, Subscriber agrees to pay the subscription fee as detailed on the Company’s website or as otherwise agreed upon between the parties.
1.2. The subscription fee is billed on a recurring basis in accordance with the selected subscription plan. Subscriber hereby authorises the Company to bill the payment method provided by Subscriber for the subscription fee.
1.3. Subscriber acknowledges that subscription fees are non-refundable except as expressly provided in these Terms or as required by law.
2. Term and Termination
2.1. The term of the subscription shall commence upon Subscriber’s acceptance of these Terms and shall continue for the duration of the subscription period, which is 12 months from the date of payment receipt being confirmed or unless terminated earlier in accordance with these Terms.
2.2. Either party may terminate the subscription upon written notice to the other party. Upon termination, Subscriber’s access to the Service will cease, and any outstanding fees shall become immediately due and payable.
3. Delivery of Magazine
3.1. The Company will make reasonable efforts to provide access the magazine via the ‘Digital Forensics Magazine’ website [digitalforensicsmagazine.com] to the Subscriber in a timely manner. However, the Company shall not be liable for any access issues or delays in delivery beyond its control.
3.2. Subscriber is responsible for providing accurate and up-to-date subscription information. The Company shall not be liable for any non-provision of access to the magazine due to inaccurate or incomplete information provided by Subscriber.
4. Use of Service
4.1. Subscriber agrees to use the Service only for personal, non-commercial purposes and in compliance with all applicable laws and regulations.
4.2. Subscriber shall not share, distribute, or otherwise transfer access to the website, magazine or any content therein to any third party without the prior written consent of the Company.
5. Intellectual Property
5.1. All intellectual property rights in the magazine, including but not limited to copyrights, trademarks, and trade secrets, are owned by the Company or its licensors.
5.2. Subscriber is granted a limited, non-exclusive, non-transferable license to access and read the magazine for the duration of the subscription term.
6. Limitation of Liability
6.1. To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with the subscription or use of the magazine.
6.2. In no event shall the Company’s total liability to Subscriber for all claims arising under these Terms exceed the total amount paid by Subscriber to the Company under the subscription during the twelve (12) months preceding the claim.
7. Governing Law and Jurisdiction
7.1. These Terms shall be governed by and construed in accordance with the laws of England and Wales.
7.2. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of England and Wales.
8. Amendments
8.1. The Company reserves the right to modify or amend these Terms at any time. Any such modifications or amendments shall be effective upon posting on the Company’s website.
8.2. Subscriber’s continued subscription to the Service following any such modifications or amendments shall constitute acceptance of such modifications or amendments.
9. Entire Agreement
9.1. These Terms constitute the entire agreement between Subscriber and the Company with respect to the subject matter hereof and supersede all prior and contemporaneous agreements and understandings, whether oral or written.
By subscribing to the Service, Subscriber acknowledges that they have read, understood, and agreed to these Terms and Conditions. If Subscriber does not agree to these Terms and Conditions, they should not subscribe to the Service.
